INFORMATION ON THE PROCESSING OF PERSONAL DATA

1. WHY THIS INFORMATION

We would like to inform you, as required by the Regulation (EU) 2016/679 (hereinafter referred to as “Regulation” or “GDPR”, about how we process personal data of users who consult the ARCEUSRE website hereinafter referred to as “ARCESURE”).

This information is also provided pursuant to Articles 13-14 of the GDPR to those who interact with the web services of the Data Controller (see point 2 below), which can be accessed electronically at:

This policy is made only for this site and not for other websites, pages or services that can be reached through hyperlinks.

The processing operations related to the web services of this site take place both at the premises of the Data Controller and at the premises identified by the operator of the website and are carried out only by personnel authorized to the processing or by persons in charge of occasional maintenance operations.

No data from the web service is disseminated. Your personal information is used to fulfill your express request and may be disclosed to third parties only if necessary and if involved and functional for the fulfillment of the same.

The collection and processing of personal data collected will be carried out in accordance with the general principles of necessity, correctness, relevance, and nonexcessiveness.

3. TYPE OF DATA PROCESSED: WHAT DATA WE PROCESS

Navigation data

The computer systems and software procedures used to operate this site acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes IP addresses or domain names of computers and terminals used by users, the addresses in URI/URL (Uniform Resource Identifier/Locator) notation of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the user’s operating system and computer environment.

These data, which are necessary for the use of web services, are also processed for the purpose of:

  • Obtain statistical information on the use of services (most visited pages, number of visitors by time slot or daily, geographical areas of origin, etc.);
  • Monitor the proper functioning of the services offered.

Data reported by the user

The optional, explicit and voluntary sending of messages to ARCEUSRE’s contact addresses, private messages sent by users to institutional profiles/pages on social media (where this possibility is provided for), as well as the completion and submission of forms on ARCEUSRE’s website entail the acquisition of the sender’s contact data (first name, last name, telephone, email), necessary to respond, as well as all personal data included in the communications.

4. COOKIES

So-called cookies are used, which are small files stored on the computer’s hard drive and are used to provide services and/or information. Most cookies are “session cookies” and are therefore deleted from your hard drive at the end of your session (when you log out or close your browser). They may be present on some pages of the site in order to analyze access to web pages, personalize its services, content and advertising messages, measure the effectiveness of promotions, and ensure trust and security.

The so-called session cookies used avoid the use of other computer techniques potentially detrimental to the confidentiality of users’ browsing and do not allow the acquisition of personal data identifying the User / Interested Party.

No cookies are used for user profiling, nor are any other tracking methods employed.

5. PURPOSE OF PROCESSING

USE OF YOUR PERSONAL DATA

(a) purposes related to, instrumental to, and necessary for the operation of the site;

(b) to answer your questions, provide you with information on properties/activities of interest to you, or generally to contact you regarding services provided by ARCEUS RE related to its real estate needs;

(c) for market surveys and statistical purposes, on an anonymous basis;

(d) purposes of promotional and commercial communications related to service/product offers;

6. LEGAL BASIS FOR THE PROCESSING OF YOUR DATA

(c) the processing is necessary to fulfill a legal obligation to which the data controller is subject;

7. NATURE OF THE PROVISION OF YOUR DATA

Apart from what is specified for browsing data, you are free to provide us with your personal data listed in the appropriate masks/forms on the site.

Providing your information is optional, but refusal to provide it may make it impossible:

– To obtain response to any requests

– To use all the features of the site

Only with the express consent of the data subject (optional and revocable at any time).

8. RETENTION OF BROWSING DATA – TRANSFER OF DATA TO A THIRD COUNTRY

The data collected during your navigation on the Arceusre site:

  • will be collected and stored for the sole purpose of obtaining anonymous statistical information on the use of the site itself and to check its proper functioning, and will be deleted after processing;
  • could be used to ascertain liability in case of hypothetical computer crimes against the site;
  • will not be the subject of either dissemination or transfer to a third country, except with your specific consent.

9. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF DATA

Communication to the identified recipients will take place only if they are involved in and functional for the achievement of the purposes mentioned in point 3 above, therefore, the personal data collected and processed may be:

(a) made available to the Collaborators of the Owner, in their capacity as Data Processors or persons authorized to process personal data;

(b) disclosed to third persons, natural or legal, public administrations, professionals, law enforcement agencies, government agencies, regulatory bodies, courts or other public authorities authorized by law;

c) disclosed to business partners (with the prior consent of the Data Subject, if not involved and functional for the achievement of the purposes);

d) if necessary, transferred to another Data Controller in accordance with the GDPR, including with regard to the right to data portability;

10. CONNECTION TO SOCIAL MEDIA

Using the buttons on our site the Data Subject allows to share its content on Social Networks using specific plug-ins of (e.g.: “Like” button on the Social Facebook platform). In this eventuality the IP address of your device may be transmitted to the social media provider and processed by them.

(The legal basis for the use of technologies is Article 6 co. 1 lett. f GDPR as they are used to increase the visibility of our website(s).)

11. RIGHTS OF INTERESTED PARTIES

We inform you that, as a Data Subject, you have all the rights provided for in Articles 15 to 22, including:

  • The data subject has the right to obtain confirmation from the data controller as to whether or not personal data concerning him or her are being processed, and if so, to obtain access to the personal data and the following information: (a) the purposes of processing; (b) the categories of personal data in question; (c) the recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly if recipients in third countries or international organizations; (d) when possible, the expected period of retention of personal data or, if this is not possible, the criteria used to determine this period; (e) the existence of the data subject’s right to request from the data controller the rectification or erasure of personal data or the restriction of the processing of personal data concerning him or her or to object to their processing; (f ) the right to lodge a complaint with a supervisory authority; (g) if the data are not collected from the data subject, all available information on their origin; (h) the existence of an automated decision-making process, including profiling as referred to in Article 22(1) and (4), and, at least in such cases, meaningful information about the logic used, as well as the importance and expected consequences of such processing for the data subject.
  • the existence of the data subject’s right to request from the data controller access to and rectification or erasure of personal data concerning him or her or to object to the processing of personal data, as well as the right to data portability, including all available information about the origin of the data; to obtain, in addition, the erasure of personal data concerning him or her without undue delay pursuant to Art. 17 “Right to be forgotten.”
  • where the processing is based on Article 6(1)(a) or Article 9(2)(a), the existence of the right to withdraw consent at any time without affecting the lawfulness of the processing based on the consent given before the withdrawal;
  • The right to file a complaint with a supervisory authority;
  • have from the data controller a copy of the personal data being processed, provided that it does not infringe on the rights and freedoms of others; in the case of additional copies requested by the data subject, the data controller may charge a reasonable fee based on administrative costs. Where the request is received by electronic means, unless otherwise specified, the information shall be provided in a commonly used electronic format;

The above information will be provided:

  • within a reasonable period of time after obtaining the personal data, but at the latest within one month, considering the specific circumstances under which the personal data are processed;
  • where personal data is intended for communication with the data subject, no later than the time of the first communication to the data subject; or where communication to another recipient is intended, no later than the first communication of personal data.

All the rights of the data subject under the GDPR shall be exercised by a request addressed without formality to the Data Controller, including through an appointee, which shall be responded to appropriately without delay.
